General provisions
This privacy policy (“Privacy Policy”) outlines the policies and procedures implemented by Extraordinal Sofware, Inc. (the “Company”) regarding users’ personal information the Company collects, uses and shares in connection with the Service.
Definitions of terms used in this Privacy Policy but not defined herein, are provided in the Terms of Service (the “TOS”).
By using the Service you agree to and accept the terms and provisions of this Privacy Policy. If you do not agree to this Privacy Policy, please cease using the Service immediately.
Personal information being collected
Information user provides to the Company
The Company collects personal information provided voluntarily by users. Such personal information could include users’ first and last names, emails, nicknames (users’ fictitious names), usernames, information added by users to their account on the Service, as well as other information provided by users.
Additionally, the Company collects and stores content generated by users, including but not limited to comments, messages, pictures, photos, images, and any other content generated by users while using the Service, including metadata connected thereto.
The Company collects personal information and details associated with sales that users make using the Services, including information on what was sold, the purchaser, the sale price, Royalty rate, and other information about each transaction.
Promotions, marketing events, and surveys
The Company may, from time to time, conduct various promotions and marketing events and send invitations to participate in, and information on promotional events and surveys about the Service. The use of information the Company collects in the course of such promotions and events will be limited to sending individual communications, selecting winners, determining the results of a quiz or survey, as well as sometimes publishing aggregated responses or results on the Service or in the media. Beyond this limited use, the information retained and used by the Company will be dissociated from any personally identifiable information for the purposes of gathering and maintaining statistical data solely by and for the Company. The Company does not sell or transfer this information to any third party unless required so by law.
Information collected automatically by the Company
The Company, its affiliates and partners, may, without explicit notification to user, collect specific information related to user’s device, IP address, geographic location, hardware settings and type, operating system, browser name, language settings, wallet type, as well as number, volume, and type of transactions, number of page views, and level of interest generated (added to favourites, likes, number of comments, etc.).
The Company identifies the domain name of the user’s provider and the country (region) during the user’s visit to the Service. Information received from the user's browser is automatically logged, including the IP address, information from cookies, as well as the route to the Service and transitions from one page of the Service to another. This data is collected in such a way as to not associate it with users’ personally identifiable information (i.e. name and contact information) and thus ensuring users’ anonymity.
Information from third parties and public information
The Company may collect data from publicly available activity on a blockchain as well as from other publicly accessible sources, such as social media platforms, government agencies, etc. Such data may include blockchain addresses and information regarding purchases, sales, or transfers of Inscriptions, which may then be associated with other data user previously provided to the Company.
Use of Personal Information
The Company uses users’ personal information to:
- provide the Service, including to set up and maintain users’ accounts;
- improve and develop the Service, including the quality of its users’ experience when interacting with the Service;
- communicate with users, including to provide support services, respond to users’ inquiries, send users administrative notices;
- comply with applicable regulations, including to provide information pursuant to legitimate requests;
- enforce the TOS and this Privacy Policy provisions;
- prevent, identify, and investigate suspicious activity that may be fraudulent, harmful, or violates the law, the TOS and/or this Privacy Policy;
- protect users’, the Company’s and others’ rights;
- create anonymous data; and
- notify users of information on any on-going or completed transactions involving those users.
Personal information disclosure
The Company will disclose any personal information if so compelled by a subpoena, warrant, order or other legal instrument issued by a court of law or government agencies and authorities with proper jurisdiction.
The Company may disclose users’ personal information to third-party vendors engaged to provide certain functionality within the Service.
The Company will disclose users’ personal information to the Company’s affiliates as well as to relevant third parties in case of any the Company’s asset transfer, including but not limited to, reorganization, merger, sale, acquisition, etc.
Protecting and Storing Personal Information
The Company stores users’ personal information securely throughout the life of their account, or as may be necessary to fulfill the purposes for which it was collected, and to comply with applicable laws and regulations.
While the Company protects users’ personal information by employing physical, technical and organizational safeguards, it cannot guarantee that such personal information will not become part of an unauthorized acquisition or be lost, misused or mistreated in any other way.
The Company does not accept liability for unauthorized access, use, disclosure, or loss of personal information to the extent permitted by applicable law.
Users must immediately notify the Company if they become aware of any unauthorized access to or use of their account or have reason to believe that their account is no longer secure.
Furthermore, the Company cannot ensure the security or confidentiality of information users transmit to or receive from the Company by Internet or wireless connection.
International Transfers
The Company may transfer, store, and process users personal information to and with affiliates and service providers based throughout the world. The Company contractually obligates recipients of users’ personal information to adhere to at least the same level of security as required under applicable data protection laws.
Users’ privacy rights
In accordance with applicable law, users may have the right to:
- access to and portability of their personal information, including:
- confirming whether the Company is processing users’ personal information;
- obtaining access to or a copy, including electronic copy, of users’ personal information.
- request correction of their personal information where it is inaccurate or incomplete;
- request deletion of their personal information;
- request restriction of or object to the Company’s processing of their personal information where such processing is used for permitted direct marketing purposes; and
- withdraw their consent to the Company’s processing of their personal information. Such withdrawal will only take effect for future processing.
Users can use the ‘unsubscribe’ link at the bottom of an email from the Company to opt out of receiving future emails, if such emails are not wanted.
The Company does not respond to “Do Not Track” signals or similar mechanisms transmitted by web browsers.
Users may stop or restrict the placement of cookies, pixel tags and other technologies on their device or remove them by adjusting users’ browser or device preferences. Such restrictions and adjustments may cause the Service to operate differently.
Notice for CA Residents
For California residents only: this section applies to the Company’s processing of personal information that is subject to the California Consumer Privacy Act of 2018 (“CCPA”).
If you are a California resident and would like to receive additional details on the rights you have pursuant to CCPA regarding the personal information the Company has collected about you and disclosed for a business purpose in the preceding twelve months, please contact the Company at [email protected]
California residents have the right not to be discriminated against by the Company in their exercising of their rights under by the CCPA.
Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. To authorize an agent, provide written authorization signed by you and your designated agent and contact the Company for additional instructions at [email protected].
To protect your privacy, the Company will take steps to reasonably verify your identity before fulfilling your request. These steps may involve asking you to provide sufficient information that allows the Company to reasonably verify you are the person about whom the Company collected personal information or an authorized representative, or to answer questions regarding your account and use of the Service.
Notice for users residing outside of California
Depending on where you are located, there may be data protection and privacy laws applicable to you. If you wish to exercise any of your rights under such applicable laws, please contact the Company at [email protected] with your request that references the applicable law.
Minors
The Service is not intended for people under 18, and the Company does not knowingly collect personal information from and about minors.
If you are under 18, do not provide any personal information to the Company via the Service and stop using the Service immediately.
If a parent or guardian discovers or believes that their minor child has uploaded personal information to the Service without such parent’s / guardian’s consent, such parent / guardian needs to contact the Company at [email protected].
If the Company becomes aware that a minor has provided the Company their personal information without a parent’s / guardian’s consent, the Company will promptly delete the minor’s personal information from its systems.
